By using liferaftssouthpacific.co.nz, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions. When you purchase products via www.liferaftssouthpacific.co.nz, you accept these Terms and Conditions, and the specific conditions that apply to that purchase. Together these terms and conditions form a legal contract between you the “Buyer” and Liferafts South Pacific Ltd the “Seller” when you purchase Goods.

1.1 All prices are stated in New Zealand dollars (NZ$) and include Goods and Services Tax (GST) at 15%, unless otherwise stated. For international orders, prices may be quoted exclusive of GST where applicable.
1.2 Prices displayed on the website are subject to change without notice. Prices for items on an Order are fixed once your Order has been accepted. Subsequent price changes either up or down will not be retroactively applied to accepted Orders.
1.3 The Buyer will pay any customs duty, taxes, excess freight or other charges relating to completing delivery of the Order as advised by the Seller.
1.4 There is no obligation on the Seller to inquire as to the authority of any person placing an Order on behalf of the Buyer.
1.5 Some products — including SOLAS liferafts, immersion suits, and certain commercial marine safety equipment — are listed as Price on Application (POA). These items require a quote prior to purchase. Placing an enquiry for a POA item does not constitute a binding order until a written quotation has been accepted and payment received.
2.1 Liferafts South Pacific Ltd accepts payment by credit card, bank transfer, and other methods as advised at checkout. All online credit card transactions are processed through a secure payment gateway. Your credit card details are captured at the time you place an Order and will be charged once your Order has been accepted and prior to dispatch.
2.2 Alternative payment arrangements, including invoice terms for approved trade accounts, can be made by contacting mark@liferaftssouthpacific.co.nz.
2.3 No Order will be shipped until payment has been received and funds cleared.
2.4 In the event of any default in payment by the due date the Seller shall be entitled to charge interest to the Buyer at the rate of 1.5% per month until the amount owing and all interest has been paid in full.
3.1 For in-stock items, delivery within New Zealand will usually be made within 5–7 business days. Some products — including liferafts, immersion suits, and large marine safety equipment — are bulky or heavy items and may require freight quotation prior to dispatch. You will be contacted to confirm freight costs and delivery timeframes where applicable.
3.2 For indent (non-stock) orders or products requiring manufacture or importation, we will contact you to confirm expected lead times prior to accepting your Order.
3.3 Some Goods available on this site may be restricted in your country. It is your responsibility to comply with any such restrictions.
3.4 Risk of any loss, damage or deterioration of or to the Goods passes to the Buyer on delivery.
3.5 The Buyer acknowledges that the Seller has a security interest under the Personal Property Securities Act 1999 (‘PPSA’) in all Goods supplied by the Seller together with any debts owing to the Buyer from the sale by the Seller of those Goods and any subsequent monies collected from such a sale.
3.6 The Buyer waives its rights under the PPSA to receive a copy of any verification statement and any financing change statement.
4.1 If for any reason you are not satisfied with your purchase, please contact us directly as soon as possible. You will find our contact details on the packing slip delivered with your product, or at liferaftssouthpacific.co.nz/contact.
4.2 We do not have to provide a refund if you have changed your mind about a particular purchase or would like to cancel your Order, so please choose your product carefully. A refund is at our discretion and may incur an administration and restocking fee of 10% of the original purchase price. You may also be responsible for the cost of return freight.
4.3 Marine safety equipment — important notice: Certain products cannot be returned or refunded once the original packaging has been opened, tampered with, or the product has been deployed or activated. This applies specifically to: Inflatable liferafts (once the canister seal has been broken or the raft deployed); Distress flares and pyrotechnics (once the outer packaging has been opened); Fire extinguishers (once discharged or the safety seal has been broken); EPIRBs and PLBs (once registered and activated); Any product specially ordered or manufactured to your specifications.
This policy reflects the nature of certified marine safety equipment, where product integrity is critical for compliance and safety purposes.
4.4 If the Goods you have received are damaged, faulty or defective in any way, notification must be made within 5 working days of receipt and this will be dealt with in accordance with clause 5.
4.5 For liferaft servicing and inspection: liferaft servicing is non-refundable once work has commenced. If you wish to cancel a servicing booking, please contact us at least 48 hours in advance.
5.1 In respect of any Goods supplied to a Buyer registered in New Zealand: to the extent the Goods are acquired by the Buyer for business purposes the Consumer Guarantees Act 1993 (“CG Act”) does not apply; the Buyer agrees to indemnify the Seller against any liability or cost incurred by the Seller under the CG Act as a result of any breach by the Buyer of its obligations under the CG Act to any person; and nothing in these terms is intended to have the effect of contracting out of the provisions of the CG Act except to the extent permitted under that Act.
5.2 In the event of any Claim under these Terms, at the Seller’s discretion Goods may be repaired or replaced or the Price refunded. These are the sole remedies available to the Buyer for default by the Seller under these terms.
5.3 In any event, the Seller’s liability arising out of any Claim or otherwise under these Terms will not exceed the Price of the Goods. No claim may be made against the Seller for consequential damages or loss of profits.
5.4 The only guarantees agreed to by the Seller are those confirmed by the Seller in writing.
5.5 Marine safety equipment must be maintained, serviced and used strictly in accordance with the manufacturer’s instructions and any applicable Maritime New Zealand or SOLAS requirements.
6.1 Except to the extent expressly set out in these Terms you acknowledge that Liferafts South Pacific Ltd will not be liable for any damage, loss, cost, Claim or expense arising out of or relating to the supply of Goods, your use of this site or any linked site, or your reliance on information accessed through this site.
6.2 To the maximum extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded.
6.3 Subject to the other express provisions of these Terms, the maximum liability of the Seller to the Buyer for any Claim relating to the supply of Goods and services shall be limited to the value of those Goods and services supplied.
7.1 Although the information provided on this site is presented in good faith and believed to be correct as at the date it was submitted, we make no warranties or representations about the accuracy or completeness of this site or any linked website.
7.2 Product specifications, certifications, and compliance requirements may change. It is the Buyer’s responsibility to verify that any product meets the specific requirements of their vessel, survey authority, or intended use before purchase.
7.3 You must take your own steps to ensure that accessing this site does not expose you to viruses or other interference. We do not accept responsibility for any damage to your computer system arising out of your use of this site.
8.1 If any Event of Default occurs, the Seller may suspend or terminate these Terms; any Amount Owing will immediately become due; each security interest created by these Terms will become enforceable; and the Buyer must return the Goods promptly on request.
The Buyer acknowledges that the Seller is the exclusive owner of all Intellectual Property in any Goods and related services supplied under these Terms. The Buyer will not claim any interest in or attempt to copy or re-engineer those Goods.
The Buyer also acknowledges that Liferafts South Pacific Ltd owns all intellectual property rights in the liferaftssouthpacific.co.nz website.
10.1 Neither party will be liable for delay or failure in performance caused by a Force Majeure Event.
10.2 Affected obligations are suspended during the Force Majeure Event, and notice must be given with full particulars.
10.3 If performance is prevented for 180 days, either party may terminate these Terms with 14 days’ notice.
11.1 The Buyer agrees that Liferafts South Pacific Ltd may obtain information about the Buyer from any person, including credit or debt collection agencies.
11.2 The Buyer agrees that Liferafts South Pacific Ltd may use and disclose information relating to the Buyer’s creditworthiness for credit assessment or debt collection purposes.
12.1 Failure or delay by the Seller in exercising any right does not prejudice that right unless specified in writing.
13.1 The Buyer may not assign its rights without written consent. The Seller may assign its rights without the Buyer’s consent.
14.1 These Terms are governed by New Zealand law and subject to the jurisdiction of New Zealand Courts.
15.1 “Amount Owing” means all amounts owing by the Buyer to the Seller.
15.2 “Buyer” means the person purchasing the Goods.
15.3 “Claim” includes any claim for loss of profits or consequential loss arising from breach, cancellation, negligence or other acts.
15.4 “Liferafts South Pacific Ltd” means the company operating liferaftssouthpacific.co.nz.
15.5 “Event of Default” means any event where the Buyer fails to comply with these Terms or enters insolvency.
15.6 “Force Majeure Event” means events beyond a party’s control including natural disasters, war, strikes, or government action.
15.7 “Goods” means all goods and/or services supplied under these Terms.
15.8 “Order” means an order placed by the Buyer.
15.9 “Order Acknowledgement” means acceptance of an Order.
15.10 “Ownership” means legal and beneficial ownership of the Goods.
15.11 “Person” includes any legal entity.
15.12 “Price” means the purchase price and any taxes or costs payable.
15.13 “Seller” means Liferafts South Pacific Ltd and related entities.
15.14 “Terms” means these terms of sale.
15.15 References to legislation include amendments or replacements.
